Post-Retirement Benefits Class Action

This class action concerns the termination of post-retirement benefits for Canadian retirees who worked for Avon Canada Inc.

Class members worked for Avon for years in order to earn post-retirement benefits, which Avon promised would be available at retirement. However, Avon has announced that effective January 1, 2020, it will terminate all post-retirement benefits for Canadian retirees.

The plaintiffs are bringing this lawsuit on behalf of all retirees to seek a court order to direct Avon to continue the post-retirement benefits or make an award of damages. This lawsuit does not concern a registered pension plan.

Updates

February 7, 2024 – Parties continue discoveries

The parties are currently in discoveries, which means exchanging affidavits of documents and productions. Once documents are exchanged, the parties will complete examinations for discoveries. During these examinations, key witnesses will be questioned in advance of a trial.

We will provide further updates as they become available.

February 3, 2023: Avon Class Action Certified, Notice Sent to Class Members

The Ontario Superior Court of Justice has certified a class proceeding in this case on January 20, 2022. A Notice of Certification has been mailed to the last known address of all class members and is available here.

January 20, 2022: Class action certified

This class action was certified on consent on January 20, 2022.  The issued and entered order can be found here.

The next steps in this class action will be sending a notice to the class about the certification, and the defendants serving a statement of defence.

August 6, 2021: Defendants serve motion material / Les défendeurs ont signifié leur dossier de réponse

The defendants have served their responding record in this class action. The responding record is the evidence the defendants will use to oppose certification of this case as a class proceeding.  You can read the responding record below. The next step in the case will be the potential cross-examinations. Any cross-examinations must be completed by September 30th.

December 22, 2020:  Plaintiffs serve motion material

The plaintiffs’ motion record in support of the certification hearing has now been served on the defendants. The motion record is the written evidence the plaintiffs will use at the court hearing to support this case becoming a class action.  You can read the plaintiffs’ motion record here.

The next step is for the defendants to serve their responding motion record, which will be the written evidence the defendants will use at the certification hearing. That record will be posted here when it is served on the plaintiffs.
