Biography
Jamie Shilton is a litigator who uses the legal system to help workers and members of marginalized communities seek redress and accountability from governments, corporations, and institutions. His practice involves a mix of class actions and civil litigation.
Jamie has litigated class actions across Canada. His experience spans employment law, consumer protection, Indigenous rights, and claims under the Charter of Rights and Freedoms. Highlights of Jamie’s experience include:
- Estey v. Nova Scotia, a class action on behalf of people with disabilities in Nova Scotia who had experienced discrimination in that province’s social assistance system, which resulted in one of the largest settlements in Nova Scotia’s history;
- Lapple et al. v. Ontario / Dadzie et al. v. Ontario and Canada, class actions on behalf of prisoners and immigration detainees who were locked down due to staff shortages in provincial prisons, which resulted in one of the largest class action settlements in Ontario’s history;
- Dine v. Biomet et al., a class action related to metal-on-metal hip implants which resulted in a significant settlement for people whose implants had failed; and
- Newell v. Ontario, a class action on behalf of Black prisoners in provincial prisons who allege that they have been disproportionately given higher-security classifications, in violation of the equality guarantees of the Charter;
Jamie has represented clients in the courts of British Columbia, Manitoba, Ontario, and Nova Scotia, and in the Federal Court. He is one of the few lawyers in Canada to have acted as counsel in a class action common issues trial.
Prior to his call to the Bar in 2020, Jamie completed a clerkship at the Ontario Divisional Court, where he assisted judges in the resolution of appeals and judicial review applications across all areas of law. As a student at Osgoode Hall Law School, Jamie worked in housing law at Parkdale Community Legal Services and West Toronto Community Legal Services. He also holds an M.A. in Political Science from York University.
Outside of the law, Jamie is a runner, filmgoer, and mediocre vegetable gardener.
