Simon Archer, Jamie Shilton and Umaiyahl Nageswaran author report for Banks and Climate Litigation Project

Lawyers with Goldblatt Partners LLP have contributed a report to the British Institute of International and Comparative Law (BIICL)’s Banks and Climate Litigation Project. The initiative investigates the evolving area of climate litigation against banks as well as claims related to the environmental impacts of projects financed by banks in select jurisdictions.

As set out in the Canada Report authored by Simon Archer, Jamie Shilton, and Umaiyahl Nageswaran, climate-related litigation against Canadian banks is still developing. The report includes:

  • a primer on the Canadian legal system, including our climate laws and regulatory framework;
  • a summary of important cases and legal developments in Canadian environmental and climate litigation;
  • an examination of potential causes of action for Bank Climate Claims in Canada; and
  • an exploration of the relevant evidentiary and procedural issues, as well as the potential remedies.
