Unpaid Overtime Class Action

What the class action is about

On October 1, 2014, Goldblatt Partners LLP, Sotos LLP and Roy O’Connor LLP commenced a class action lawsuit against the defendant, Livingston International Inc. (“Livingston” or the “defendant”) for unpaid overtime.

The proposed national class action is in respect of unpaid overtime work at Livingston offices across Canada, and Livingston’s practices and policies in respect of overtime pay. The action is brought on behalf of a proposed class consisting of all current or former non-management employees of Livingston in its offices across Canada, in administrative, clerical, technical and supervisory job classifications or otherwise subject to Livingston’s overtime policy or policies.

The class action alleges that, since August 15, 2007, Livingston has failed to pay Class Members compensation for overtime worked.

May 11, 2021:  Second distribution of payments

March 23, 2021:  IMPORTANT UPDATE FOR CLASS MEMBERS:

The first distribution of settlement payments to Class Members is now complete.  T4s have been mailed to all Class Members who received payments in 2020.

October 19, 2020: Update on compensation cheques

As  noted below, the first instalment of compensation cheques were mailed out by July 30, 2020 to all class members who made a claim and to all class members who were current employees in the class period. A second instalment will be sent in early 2021.

Compensation cheques are scheduled to be mailed on July 30th.

June 3, 2020:  Update on settlement fund distribution

We have been working alongside the Administrator to deliver compensation to class members who have submitted claims as soon as reasonably possible.  However, the pandemic and other events beyond our direct control have impacted this process. This includes efforts, as approved by the Court, to take additional steps in an attempt to locate various class members.

Our best estimate as to the timing for delivery of compensation to class members is 30 days. If your mailing address has changed, please contact us.

April 14, 2020:  Settlement funds to be distributed / Fonds de règlement seront distribués

The administrator and class counsel are now preparing to deliver the first distribution of settlement funds. The cheques for the first distribution should be mailed in May to the addresses that class members have provided to the administrator.

L’administrateur et l’avocat du groupe se préparent maintenant à effectuer la première distribution des fonds de règlement. Les chèques de cette première distribution devront être postés en mai aux adresses postales fournies à l’administrateur par les membres du groupe.

January 14, 2020:  Claims period has been extended

The claims period has been extended to allow for further notification of additional former employees who are members of the Class.  We expect that distribution of settlement money will begin in the early Spring.

If you are a class member you can now ask for your share of the settlement.

Note:  You must ask for your share of the settlement by October 15, 2019, otherwise you cannot get any money from the settlement.

You can also complete and mail in a settlement payment form, but it must be received by no later than October 15, 2019.

June 21, 2019:  Court approves settlement / Le tribunal a approuvé le règlement

The Ontario Superior Court of Justice has approved the settlement reached by the parties in this unpaid overtime class action against Livingston. This means the settlement of the class action will be going ahead. Class members cannot ask for compensation yet.

Class members will be able to ask for a share of the settlement after July 31. A distribution form and notice will be sent after July 31 to the last known address of class members. The notice will tell class members how to ask for their share of the settlement. That information will also be posted here – so if you are a member of the class, visit this page after July 31 to find out what to do.

A third party administrator, RicePoint Administration Inc., has been appointed to handle the distribution of the settlement monies.

Le tribunal a approuvé le règlement, le protocole de distribution et les honoraires des avocats du groupe demandeur dans le présent recours collectif. Cela signifie que le règlement du recours collectif se poursuivra. Les membres du groupe ne peuvent pas encore demander de compensation.

April 10, 2019:  The class action has been tentatively settled / Les parties ont convenu de régler ce recours collectif

The parties have agreed to settle this case for a total of $19 million (including legal fees, disbursements and the costs of administering the settlement.)

The settlement is subject to approval by the Superior Court. The settlement approval hearing will be held on June 21, 2019 at 491 Steeles Avenue East, Milton Ontario.

Les parties ont convenu de régler ce recours collectif pour une somme de 19 millions de dollars (y compris les frais juridiques, les débours et les frais associés à l’administration du règlement).

Ce règlement est sujet à l’approbation de la Cour supérieure. L’audience d’approbation du règlement aura lieu le 21 juin 2019 au 491, ave. Steeles Est, Milton, Ontario.

May 9, 2017: Notice of Certification

The Notice of Certification has been released.

November 17, 2016:  The class action has been certified

On November 17, 2016, the Ontario Superior Court of Justice certified the action, which means it will proceed as a class action.

The class is comprised of:

All current or former non-management employees of the defendant in its offices across Canada, who are or were employed, at any time on or after August 15, [2007] in administrative, clerical, technical and supervisory job classifications or otherwise subject to the defendant’s overtime policy or policies.

The next step is the discovery process, in which the parties will exchange all relevant documents relating to the issues in the class action.
