Steven Barrett will discuss key issues in raising Charter claims before an administrative tribunal at the Canadian Bar Association’s “Charter Issues at Administrative Tribunals“.
Steven and other panelists will look at: the best practices for raising a Charter argument, from timing to evidence and how to create an appropriate record; the role of the provincial and/or federal government when Charter issues arise; adjudicative versus other administrative tribunals; the availability of Charter damages; and the issues arising from a tribunal’s lack of remedial power to make a binding declaration of unconstitutionality.
