Jessica Orkin on Aboriginal persons and the criminal justice system
Jessica Orkin will participate in a panel discussion at the Canadian Bar Association’s seminar on Aboriginal Peoples in the Criminal Justice System: R. v. Kokopenace and Other Developments.
The panel will discuss the scope of an accused’s right under ss.11(d) and (f) of the Charter, representativeness of the jury roll, and what the province must do to ensure that right is not violated, in light of the Court of Appeal’s decision in R. v. Kokopenace. The panel will also address important updates on sentencing of Aboriginal accused post-Gladue and the recent Supreme Court of Canada decision in R. v. Anderson.
