Court certifies class action against Bell Mobility

On September 4, 2013, the Ontario Superior Court of Justice certified a class action against Bell Mobility Inc. in relation to pre-paid mobile telephone services.

The claim alleges that Bell illegally seized customers’ credits on the stated expiry date, instead of “after” the stated expiry date as provided by the Terms and Conditions. The claim also alleges that the expiry dates themselves are illegal under the Consumer Protection Act, 2002  because pre-paid cards are “gift cards” within the meaning of the legislation.
