Challenge to Bill 5’s interference in Toronto election filed with the Superior Court

Chris Moise, currently registered as a candidate for Toronto City Council; Ish Aderonmu, an elector; and Prabha Khosla, an elector and member of Women Win TO, have filed an application with the Superior Court of Justice challenging Bill 5 – the so-called Better Local Government Act.

The application alleges that changing the rules and the scope of an election in the middle of the election violates sections 2(b), 2(d) and 15 of the Canadian Charter of Rights and Freedoms, as well as the unwritten constitutional values of the rule of law and democracy. The applicants will ask the court to strike down Bill 5 and allow the election to proceed under the previously determined ward boundaries.

This application will be heard with other applications challenging Bill 5 on August 31, 2018.
